Terms of Use
ARTICLE 1: PURPOSE
These Terms of Use define the conditions under which iFotoLife provides its clients, hereinafter referred to as "Clients", with an online photo account management service on its mobile application iFoto, as described below.
Using the application implies acceptance of these terms of use.
ARTICLE 2: Description of the application
The iFoto application, a virtual stand dedicated to iFotoLife clients, is a free application accessible from Play Store and App Store via Smartphone or tablet. It allows iFotoLife Clients to have a unique access account to view using facial recognition, modify and download their photos after payment.
2.1 Conditions for accessing the Client Space
The iFoto application is intended exclusively for Residential, Professional, and Business Clients of iFotoLife who have visited or attended one or more events where iFotoLife was present.
Only one Client account can be created per valid email address.
Once the Client account is created, the User must take a recent photo with their device so that the application can search for their photos on the platform, list them for them, so they can select, choose the resolution, and download them after payment.
2.2 Creating access codes to the Client Space
The User accesses the application from Play Store for Android devices and App Store for iOS devices via Smartphone or tablet, then creates a user account with their email address, and takes an instant photo for facial recognition.
ARTICLE 3: CONTENT OF THE CLIENT SPACE
The User's right to access the application is personal and non-transferable.
The iFoto application for iFotoLife Clients offers the User the ability to:
View their photos;
Select and choose the resolution;
Pay for their selection either by cash or through their PayPal account.
ARTICLE 4: DURATION OF CLIENT SERVICE
Membership in the iFoto application is concluded for an indefinite period from the acceptance of these Terms of Use by the User.
However, access to the Client Space is terminated when the User decides, either by deactivating or deleting their account.
Termination of one of the subscriptions causes the corresponding contract to be closed in the application.
ARTICLE 5: CLIENT OBLIGATIONS
The User agrees to:
Not take any action that could harm, in any way, iFotoLife, especially its technical platforms, image, and commercial interests.
Use the application in accordance with current regulations and for the purpose for which it was designed and marketed.
Use the application in a strictly personal and private manner. The commercialization of the application, in any form, is strictly prohibited.
Keep the confidential access codes associated with the Service under their sole responsibility and not disclose them to any third party. The Client acknowledges that providing accurate information when creating and managing their Client Space service is crucial for the proper provision of the service and agrees to provide up-to-date, complete, and accurate information about themselves. The Client is solely responsible for the information they transmit when using their account and, in particular, for correctly entering said information.
The Client is expressly informed that the contents related to the Internet and received by them are under their sole responsibility, regardless of the mode, especially during the Internet connection. Therefore, the Client assumes full civil and criminal responsibility for these operations.
ARTICLE 6: OBLIGATIONS – LIMITATION OF LIABILITY OF iFotoLife
iFotoLife commits to:
Implementing all necessary means for the proper functioning of the iFoto application and the Services offered therein, and maintaining their continuity and quality;
Making every effort to ensure access to the iFoto application and Services 24/7, except in cases of force majeure, temporary technical failures, or network disruptions;
iFotoLife shall not be liable for any indirect and/or immaterial damages suffered by the Client in connection with the use of the iFoto application and Services.
ARTICLE 7: CONFIDENTIALITY
The User agrees to take all necessary measures to keep and use their access codes to the iFoto application strictly confidential. They must take all necessary precautions, particularly not to disclose them to a third party. iFotoLife informs the User that they may be held responsible in case of disclosure and use of their access codes by a third party due to proven negligence on their part regarding these confidentiality and security obligations.
Therefore, any consultation of the Client Space and all operations carried out from the said Client account using their access codes are presumed to be made by the User.
When the User suspects unauthorized or fraudulent use of their access codes, they must immediately inform iFotoLife by contacting Customer Service to request the blocking of their access code to the Client Space. The User's access to their Client account will be suspended.
ARTICLE 8: PERSONAL DATA
The User's personal data collected to allow access to the iFoto application and the Services it contains are subject to automated processing by iFotoLife and are treated in compliance with the provisions of law No. 09-08 relating to the protection of individuals regarding the processing of personal data.
By accessing the Services, the User agrees that iFotoLife, as the data controller, processes their personal data necessary for managing their orders or, if applicable, entrusts the processing to its subcontractors, subject to confidentiality and data protection rules to which these providers will also be contractually bound.
iFotoLife may, for the proper functioning of its Service, use temporary cookies. These cookies do not allow any identification of User data, and they can be refused by configuring their browser.
The User agrees that iFotoLife may send them information related to the services used or other similar services and products to inform them of new features and benefits they may receive.
In accordance with law 09-08, the User has the right to access, rectify, and object, namely to unsubscribe, regarding their personal data, which they can exercise via the website.
ARTICLE 9: Bank Data
The bank data transmitted during payments are collected and stored by the online payment service provider Centre Monétique Interbancaire (CMI).
iFotoLife shall not be liable for any damages suffered by the Client due to fraudulent use of their bank card following a loss or theft and/or disclosure of their confidential access code.
ARTICLE 10: Force Majeure
iFotoLife cannot be held responsible, or considered to have failed these terms of use, for any malfunction or non-performance when the cause of the malfunction or non-performance is related to a case of force majeure as defined by jurisprudence, particularly in the event of fraudulent and unauthorized introduction into an automated data processing system, unavailability of equipment, interruption, suspension, reduction, or disturbances of electricity or other, or any interruptions of telecommunications networks.
ARTICLE 11: SUSPENSION - TERMINATION
iFotoLife reserves the right to revoke and block, without notice, access to the iFoto application in case of fraudulent use of the said space by the User, as well as in case of non-compliance by the User with the provisions of these general conditions, particularly in case of non-compliance with the confidentiality and security rules of their access code.
iFotoLife may suspend access to the iFoto application:
At the request of the User suspecting fraudulent use of their access code.
If incorrect information was provided during online registration for the Service.
ARTICLE 12: ENFORCEABILITY OF ELECTRONIC EXCHANGES
The parties agree that the records of transactions and electronic exchanges on the computer servers and/or information systems of iFotoLife or subcontractor partners constitute proof of the operations carried out by the User and justify their allocation to the concerned User's account. The parties recognize and admit that these records (and their reproduction on any medium) have evidentiary value in court.

ARTICLE 13: MODIFICATION
Any modification of these terms of use will be communicated to the Client by any means, including through dissemination on the iFotoLife website.
ARTICLE 14: DISPUTES – APPLICABLE LAW
Any dispute arising from these general conditions that cannot be settled amicably will be under the exclusive jurisdiction of the Commercial Court of Marrakech.
These terms are subject to Moroccan Law for both interpretation and execution.
General Terms and Conditions of Sale for the Ifotolife Application
1. Preamble
These conditions govern the sales of digital photos by the Ifotolife application, owned by Pyramide Photo, a company registered in Marrakech RC ( ), hereinafter referred to as "the Seller".
2. Description of the Service
Ifotolife is a mobile application that allows users to search for, purchase, and download digital photos. Users can make payments through integrated secure methods.
3. Access to the Service
To access the service and make transactions, users must create an account by providing accurate and complete information. The user account must be used responsibly and securely.
4. Prices
The prices of the photos are indicated in euros and are subject to change without notice. Payment is due immediately upon ordering.
5. Payment
Payment can be made by credit card, PayPal, or any other means provided by Ifotolife. Transactions are secured by an encryption system to protect all data related to personal information and payment methods.
6. Download
After purchase, photos will be available for download in the "My Purchases" section of the application. Users receive a non-exclusive, non-transferable license to use the photos for personal and non-commercial purposes.
7. Copyright
Photos sold via Ifotolife remain the property of their respective authors. Users agree not to violate the copyright and related rights of the photographers.
8. Cancellation and Refund
Once photos are downloaded by the client, no withdrawal or refund is allowed, given the digital nature of the downloadable products.
9. Liability
The Seller cannot be held responsible for interruptions or malfunctions of the service due to external causes, such as internet network failures or degradations.
10. Changes to the Terms
The Seller reserves the right to modify these general terms and conditions without notice. Changes will be applicable immediately after their publication on the application.
11. Applicable Law and Jurisdiction
These general terms and conditions are governed by French law. Any dispute related to their interpretation and/or execution falls under the jurisdiction of French courts.
